Welcome to Villabookersonline. By using or accessing www.villabookersonline.com (the "Site"), you acknowledge that you are subject to the following terms and conditions (the "Terms"). You should read through the Terms carefully; they constitute a legally binding agreement. You are contracting with Villabookers Limited ("we" or "us"). If you do not fully agree to these Terms, you may not access or otherwise use the Site.
These Terms apply from May 2009.
1. Use of the Site:
A condition of your continued use of this Site is that you agree not to use this Site for any purpose that is unlawful or prohibited by these terms and conditions or by other applicable laws and regulations. Your continued use of the Site also signifies that you indemnify Villabookersonline from any loss or damage or costs in connection with any breach of these conditions or any other legal obligation by you and your use of, or conduct on the Site.
2. Responsibility for Accuracy of Property Information:
Villabookersonline (Villabookers Ltd.) makes no representation as to the accuracy or currency of the information contained within the Villabookersonline website. The details of properties illustrated on this Site are the sole responsibility of the owner or agent. Villabookersonline does not confirm the currency or accuracy thereof and therefore you are strongly recommended to undertake your own research into the authenticity of any information supplied. Villabookersonline are in no way liable for any misleading statements or the information provided by the owner or agent of properties on the website.
While we make every reasonable effort to ensure that the accommodation or other service listed is of an acceptable standard, the listing of any accommodation premises or other service on this Site is not and should not be taken to be a recommendation from Villabookersonline, or a representation that the premises or other service will be suitable for your purpose. We shall not be liable to you in the event that the accommodation or other service is not suitable for your purpose.
3. Insurance
You are strongly recommended to take out personal travel insurance for all members of your party. It is your responsibility to ensure that the insurance you purchase is adequate and appropriate for your particular needs. Please read your policy details on receipt and take them with you on holiday.
4. Bookings
Upon confirming a reservation, you agree to pay a non-refundable and non-transferable deposit in addition to any booking fees in effect at the time of booking. You will be responsible to pay the owner/agent concerned for the balance which will be due prior to departure. Full details will be advised to you by the owner/agent during the booking process. Any cancellations must be made directly with the owner/agent in accordance with their cancellation policy (detailed in their terms and conditions). Deposits are non refundable and non transferrable in the event of you cancelling or amending a booking. Every effort is made to ensure that the owner/agent processes your booking correctly, though in the unlikely event of a problem arising, our liability is limited to the deposit paid only.
5. Credit / Debit card transactions
Your debit/credit card will be debited only when the property owner or appointed agent confirms your booking. Your statement will show a payment to "Overseas Property Wimborne" who operate the merchant account for Villabookersonline.com. You will receive a confirmation email at each stage of the transaction. Villabookersonline makes all reasonable efforts to ensure that card transactions are secure. However, if unauthorised charges appear on the credit /debit card (statement) you have used on Villabookersonline at any time during or after you have made your reservation or disclosed your credit / debit card details on the website, Villabookersonline shall not be liable in any way regarding any damage or loss suffered by you, arising from or in any way connected with the use, transaction or disclosure of the card details.
6. Arriving at the Property:
Make sure that you have the address and directions to the property. These are normally sent to you on payment of the balance. Some owners will send you a key in advance, some may be there to welcome you, whilst others may have a local representative to greet you (in this case please make sure that you have the telephone number of the owner or their representative so that you can call to let them know if your arrival time is delayed).
7. Any Problems:
All owners should leave instructions at the property for contacting either themselves or their local representative. If you find that you have a problem or an item of equipment breaks down, please call them straight away. Either they or their representative will have the local knowledge to put things right. It is essential to air any difficulties on the spot as this gives the owner the chance to ensure your holiday is not spoilt. Please do not save up complaints until after you return home.
8. Privacy:
Villabookers Limited is registered in England and Wales, Company registration number: 06756718. Our registered office is: 7 The Square, Wimborne, Dorset BH21 1JA. We are registered under the Data Protection Act 1998, number Z1735298. Villabookersonline is committed to safeguarding the privacy of its users and takes reasonable steps to ensure that your personal information is stored safely and accurately. If you have any queries or comments about the policy or our use of your personal information, please get in touch with us by emailing support@villabookersonline.com or writing to The Privacy Manager at 7 The Square, Wimborne, Dorset, BH21 1JA.
The information we collect about you will enable you to use the services available on the website and help improve the services we offer. They will also be used to provide information to carefully selected third parties and support our own marketing and promotional campaigns.
When you visit, register or use the services on this Site, we will collect, use and store information about you, including your name and your contact details. We may also collect information about your computer and about your visits to and use of this website. Finally, we may collect information about property you own and the type of property you wish to rent for vacation purposes. We may aggregate the information to produce statistical information about our users which we can use in our marketing and assist us in the further development and improvement of our Site.
We may also use your information to deal with enquiries and complaints made by or about you relating to the website. If you do not wish to be contacted in the future, please email support@villabookersonline.com and let us know. Registered agents can update their information on their My Profile section once logged in.
As a user of this Site you can request we provide you with any personal information we hold about you. Provision of such information may be subject to the payment of a fee. You may ask us to make any necessary changes to ensure that such information is accurate and kept up-to-date.
We do not use 'cookies' on this website. This technique is not considered best practice for modern websites and by not using 'cookies' we are complying with best practice and ensuring full functionality of the site whether or not your PC has 'cookies' enabled. This also means that we do not store any information on your PC without your knowledge.
In order to allow continuous improvement to your website experience, we use log files to record data relating to our visitor traffic. These record data such as IP addresses, pages visited and for how long. This data is confidential for internal statistical use and does not identify individual users.
We will take reasonable technical and organisational precautions to prevent the loss, misuse or alteration of your personal information. The computers that store your information are kept in a secure facility and we use secure firewalls and other measures to restrict electronic access. Should we enter into a sale/merger, we reserve the right to disclose your information to any new owner. We may change our privacy policy from time to time as we add new services or in response to changes in the law or our commercial arrangements. Any changes to our policy will be posted on this page.
Villabookers will only disclose your personal information to other people or organisations if we have obtained your consent to do so or in exceptional circumstances where we are required or permitted to do so by law.
We will also use the personal data you provide to us to contact you from time to time with important user or service updates, and to send other messages that are integral to the service we provide on the Site. If you have an account on the Site, we must always be able to e-mail you operational information about your account and your use of our services.
9. Removal of Property Descriptions:
If Villabookersonline receives upheld complaints from site users about specific Property Descriptions which are felt to be misleading or contain unsuitable material, then we reserve the right to remove the Property from the Site with immediate effect. Villabookersonline reserves the right to block any Property Descriptions from its Site where the content fails to meet our minimum requirements.
10. Links to Third-Party Sites:
This Site may contain links and pointers to other Internet sites, resources, and sponsors of the Site. Links to and from the Site to other third-party sites, maintained by third parties, do not constitute an endorsement by us of any third-party sites or the contents thereof.
11. Limitation of Liability:
11.1. In no event will we, the Site, any officers, directors or employees be liable for any lost profits or any indirect, consequential, special, incidental, or punitive damages arising out of, based on, or resulting from our Site, these Terms, your use of the Site and/or any transaction between users, even if we or they have been advised of the possibility of such damages. These limitations and exclusions apply without regard to whether the damages arise from (1) breach of contract, (2) breach of warranty, (3) strict liability, (4) tort, (5) negligence, or (6) any other cause of action, to the maximum extent such exclusion and limitations are not prohibited by applicable law. If you are dissatisfied with the Site, you do not agree with any part of these Terms, then your sole and exclusive remedy against us is to discontinue using the Site. In all events, our liability, to you or any third party in any circumstance arising out of or in connection with the Site is limited to the greater of £100.00 in the aggregate. Nothing in these Terms shall exclude or restrict our liability for death or personal injury resulting from our negligence; nor for our fraud or our fraudulent misrepresentation.
12. Disclaimer:
12.1. We warrant that the Site will be provided with reasonable care and skill with the intention of meeting our technical specifications for the Site, but we cannot and do not guarantee that the Site will meet your requirements, including (without limitation) as to the availability or speed of delivery of the Site, any of its features of content, any communication through or relating to the Site, or any transaction you may enter into with other users. Except as expressly stated elsewhere in these Terms, all representations, warranties, conditions and other terms relating to the Site or any of its content, whether express or implied (by common law, statute, collaterally or otherwise) are hereby excluded, except in the case of our fraud or our fraudulent misrepresentation, or where such exclusion is not permitted by law. We do not warrant that the functions of the Site or any materials or content contained therein will be uninterrupted or error free, that defects will be corrected, or that the Site or the server that makes it available is free of viruses or other harmful components, although we will take reasonable steps to avoid ourselves introducing viruses or other harmful components to the Site.
12.2. You acknowledge that any transmission to and from this Site is not confidential and your communications may be read or intercepted by others.
13. Release:
In the event that you have a dispute with one or more other users (including, without limitation, any dispute between users regarding any transaction or user-contributed content), you hereby agree to release and discharge us from all liabilities, claims and expenses which arise out of or in connection with that dispute.
14. Choice of Law and Forum:
This Agreement shall be governed by and construed in accordance with the laws of England and Wales and subject to the non-exclusive jurisdiction of the English courts.
15. Complaints:
If you have any complaints concerning any services we provide, you must inform us straight away in writing and in any event within 28 days of the end of any arrangements booked through us. We regret we cannot accept any liability if we are not so notified. Our maximum liability to you if we are found to have been at fault in relation to any service we provide (as opposed to any service provided by any accommodation owner for whom we are not responsible) is limited to the deposit you pay to us in relation to the booking in question. We do not exclude or limit any liability for death or personal injury which arises as a result of our negligence or that our employees whilst acting in the course of their employment.
16. Your Record of These Terms:
We do not separately file the Terms entered into by each user of the Site. Please make a copy of these Terms for your records by printing and/or saving a downloaded copy of the Terms on your personal computer.
